1. Introduction and Scope
This Privacy Policy (“Policy”) explains how Imagativ, LLC (“Imagativ,” “we,” “us,” or “our”), located at PO Box 648, Fishkill, NY 12524, collects, uses, shares, and protects personal information collected through our Online Business Presence Audit funnel (the “Audit”), including our Audit request form, scheduling process, related Meeting, and follow-up communications. This Policy works together with, and should be read alongside, our Terms and Conditions for the Audit service. It applies to personal information we collect directly from you; it does not apply to information collected by third-party websites or services we link to or that you may use independently of the Audit.
2. Information We Collect
Information You Provide Directly: When you submit the Audit request form, we collect information such as your name, email address, phone number, business name, business website URL, and details you share about your business and its online presence. If you communicate with us by email, phone, text, or during the Meeting, we may also collect the content of those communications and any notes taken during the Meeting.
Payment Information: When you pay the $97 Audit fee, your payment is processed by Stripe, our third-party payment processor. We do not collect or store your full credit card number; Stripe collects and processes that information directly under its own privacy policy and security standards.
Information Collected Automatically: When you visit our website or funnel pages, we (and our service providers) may automatically collect technical information such as your IP address, browser and device type, pages viewed, referring/exit pages, and approximate location, typically through cookies and similar tracking technologies described in Section 3.
3. Cookies and Tracking Technologies
Our website and funnel pages use Google Analytics to understand how visitors use our site, and the Meta (Facebook/Instagram) Pixel to measure and inform our advertising. These tools may place cookies or similar identifiers on your browser or device and may collect information about your visit and interactions with our pages, which can be linked to a unique identifier for your browser or device.
You can control cookies through your browser settings, and you can manage how Meta uses your data for advertising through your Meta Ad Preferences. Some browsers and devices also support a Global Privacy Control (GPC) signal; where legally required to do so, we will treat a valid GPC signal as an opt-out request as described in Section 8.
4. How We Use Your Information
We use the information we collect to: (a) schedule and conduct your Meeting; (b) prepare and deliver your Audit Report; (c) process your payment; (d) communicate with you about the Audit, your Meeting, and our services by email and/or SMS; (e) operate, maintain, and improve our website and funnel; (f) measure and improve our advertising; and (g) comply with legal obligations and enforce our Terms and Conditions.
5. How We Share Your Information
We do not sell your personal information to third parties for money, and we do not share it with third parties for their own independent marketing purposes. We do share personal information with the following categories of service providers, solely to operate the Audit funnel on our behalf:
Stripe (payment processing); our customer relationship management and marketing platform (such as GoHighLevel or HubSpot), used to manage scheduling, email, and SMS communications; and Google Analytics and Meta, used for website analytics and advertising as described in Section 3. We may also disclose information where required by law, to protect our rights or the safety of others, or in connection with a merger, acquisition, or sale of business assets.
Note on advertising technologies: Some state privacy laws (including California’s) define “sharing” broadly to include disclosing information to advertising partners — such as through the Meta Pixel or Google Analytics/Ads remarketing features — for cross-context behavioral advertising, even where no money changes hands. To the extent our use of these tools constitutes “sharing” under such laws, you can opt out as described in Section 8.
6. SMS and Text Messaging
If you provide your mobile number and consent to receive text messages as described in our Terms and Conditions, we use that number solely to send messages related to your Audit, Meeting, Report, and our services. We do not sell or share mobile opt-in data or phone numbers collected for SMS purposes with third parties for their own marketing purposes. You can opt out of SMS at any time by replying STOP to any text message we send, or by emailing [email protected]. Message and data rates may apply.
7. Your Privacy Choices (Do Not Sell or Share)
Because we do not sell personal information for money, there is no “sale” to opt out of. If you would like to opt out of our use of advertising cookies/pixels (such as the Meta Pixel or Google Analytics advertising features) that may be considered “sharing” under applicable state law, you can: (a) adjust your browser’s cookie settings; (b) use your Meta Ad Preferences to limit ad personalization; (c) enable a Global Privacy Control signal in a supported browser; or (d) email [email protected] and we will work to honor your request to the extent required by law.
8. Your Privacy Rights Under State Law
Depending on your state of residence, you may have rights under comprehensive state privacy laws (such as the California Consumer Privacy Act and similar laws in other states) including the right to: know what personal information we have collected about you; access a copy of that information; correct inaccurate information; delete your personal information, subject to certain exceptions; opt out of the sale or sharing of personal information, and of certain profiling; and not be discriminated against for exercising these rights.
To exercise any of these rights, email [email protected] with your request and enough information for us to verify your identity. We will respond within the time required by applicable law (generally within 45 days, with the possibility of one extension). If we deny your request, you may have the right to appeal by replying to our response.
9. Data Retention
We retain personal information collected through the Audit funnel for as long as needed to provide the Audit, deliver the Report, support any Additional Services you engage us for, comply with legal and tax obligations, and resolve disputes, after which we will delete or de-identify it unless a longer retention period is required or permitted by law.
10. Data Security
We use reasonable administrative, technical, and organizational measures designed to protect personal information from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security of your information.
11. Children's Privacy
Our Audit funnel is directed at business owners and representatives and is not intended for, or directed to, children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us at [email protected] so we can delete it.
12. Third-Party Links
Our website, funnel pages, and communications may contain links to third-party websites or services (including the scheduling, payment, and social media platforms referenced in this Policy). We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies directly.
13. Scope: U.S. Visitors
This Policy and the Audit funnel are intended for visitors and clients located in the United States. We do not knowingly direct the Audit funnel to individuals outside the United States, and we make no representation that this Policy satisfies the laws of any jurisdiction outside the United States.
14. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will post the updated Policy with a new effective date. Your continued use of the Audit funnel after changes are posted constitutes acceptance of the updated Policy.
15. Contact Us
